Privacy Statement

Fox Group Canada Inc. (“Fox”, “we”, “our”, “us”) is committed to protecting your privacy and safeguarding your personal information. The purpose of this Privacy Statement is to inform you about the types of Personal Information we collect, use and disclose. It explains how we collect, use and disclose that information, the choices you have regarding such use and disclosure, and how you may access and correct that information.

From time to time, we may make changes to this Privacy Statement. The Privacy Statement is current as of the “last revised” date which appears at the top of this page. If we make any significant changes to the Privacy Policy, we will post a notice on our websites or contact you to inform you when required by law. We will treat Personal Information (as defined below) in a manner consistent with the Privacy Statement under which it was collected, unless we have your consent to treat it differently.   1. What is Personal Information?

“Personal Information” is any information that that can be used, either alone or in combination with other information, to identify you as an individual. This information may include but is not limited to your name, e-mail address, mailing address, telephone number, credit card information and purchase history. Personal Information, however, does not include any information that is solely used to communicate with you in relation to your employment, business or profession, such as your name, position name or title, work address, work telephone number, or work electronic address.

 

  1. What Personal Information do we collect and how we collect it ?

We will collect your Personal Information by fair and lawful means. We may collect Personal Information from you directly and/or from third parties, where we have obtained your consent to do so or as otherwise required or permitted by law. This section describes the categories of Personal Information we may collect and how we may collect it.

Information you provide to us. We collect Personal Information that you provide to us through our website or otherwise, including:

  • Contact Data, such as your first and last name, email address, billing and mailing addresses, and phone number when you purchase products or services from us on our website or when you create an online account with us.
  • Profile Data, such as your username and password that you set to establish an online account with us, age, date of birth, gender, biographical details, links to your profiles on various third-party sites including social networks, interests, preferences, and information about your participation in our events, promotions, sweepstakes, contests, or surveys.
  • Communications that we exchange, including when you contact us with questions, feedback, or otherwise.
  • Payments and Transactional Data, such as the information needed to complete your orders on or through our website (including name shipping information), and your purchase history. Please note that we do not collect your credit card and other billing information, as this information is handled by our payment processors.
  • Marketing Data, such as your preferences for receiving communications about our products, services, events, promotions and newsletters and similar messages, and details about how you engage with our communications.
  • Other Information, that we may collect which is not specifically listed here, which we will use as described in this Privacy Statement or as otherwise disclosed at the time of collection.

Automatic Data Collection. In addition, to ensure that our website is optimized for ease of use, we or our service provider(s) may use cookies and similar technologies to collect standard information about your use of our site, including your language preferences, your browser type and version, and similar information. These cookies are intended to optimize your experience of our website. We also use information collected through cookies and similar technologies to recognize a website visitor and supplement our confidential profile for that user, determine a user’s general location to tailor the website content to that user’s location, track use of the websites, and to offer personalized web page content, information and advertisements, as further described in Section 4.

 

  1. Where do we store your Personal Information?

We will keep the Personal Information that we collect at our head offices in Canada or at the offices of our third-party service providers in Canada, as applicable.

To the extent that any Personal Information is transferred outside of your country, it is subject to the laws of the country in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country.

 

  1. How do we use your Personal Information?

We identify the purposes for which we use your Personal Information at the time we collect such information from you and obtain your consent, in any case, prior to such use. We generally use your Personal Information for the following purposes (the “Purposes”):

to create and administer user accounts;

to process transactions;

as part of contests and promotions;

to respond to requests, complaints or inquiries;

to advise you about new programs and services that may be of interest to you (you can always opt out of our marketing communications, as described in Section 6);

to administer specific functions of our website;

to understand your needs and interests, and personalize your experience on our website and our communications such as by using your location information to determine your language preferences or display accurate date and time information;

to send you direct Fox-related and other direct marketing communications (you can always opt out of our marketing communications, as described in Section 6);

to display adds on the website and on other online services, for which purposes we may partner with third-party advertising and social media companies. These companies may use cookies and similar technologies to collect information about you (including the device data, online activity data and/or geolocation data described above) and your interaction over time across the website, other online services, and with our communications, and use that information to display ads that they think will interest you. This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms.  You can learn more about your choices for limiting interest-based advertising, in Section 6 below;

to investigate legal matters;

for such purposes, as you may otherwise consent from time to time; and

as otherwise required or permitted by law.

  1. To whom do we provide your Personal Information?

We generally identify to whom, and for what purposes, we disclose your Personal Information, at the time we collect such information from you and obtain your consent to such disclosure. We may also disclose Personal Information to third parties as permitted or required by applicable law (for instance to law enforcement authorities).

 

Service providers. We may transfer your Personal Information to our affiliates and/or parent company and/or third-party service providers with whom we have a contractual agreement that includes appropriate privacy standards, where such third parties are assisting us with the Purposes (such as IT, hosting, payment processing services, customer relationship management and support, print and mail fulfillment, order fulfillment and shipping, data management, email delivery, marketing, analytics, fraud detection, event management services, promotions, sweepstakes, contests and surveys). For written information about our policies and practices regarding foreign service providers outside of Canada, contact our Privacy Officer (see question 17 below). 

 

Payment Processors. When you purchase a product on our website, you will be required to use the services of a payment processor, such as Shop Pay or Google Pay. Your use of these payment processors’ services is subject to their privacy policies.

 

Business Transferees. We may disclose your Personal Information to relevant participants in business transactions (or potential transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Fox or our affiliates and parent company (including, in connection with a bankruptcy or similar proceedings). We require the information recipient to agree to protect the privacy of your Personal Information in a manner that is consistent with this Privacy Policy and applicable law.

Advertising Partners. As mentioned in Section 4, we partner with third-party advertising and social media companies to display ads on the website and on other online services;

 

  1. When and how do we obtain your consent and what are your privacy choices?

We generally obtain your consent prior to collecting, and in any case, prior to using or disclosing your Personal Information for any purpose. You may provide your consent to us either orally, electronically or in writing. The form of consent that we seek, including whether it is express or implied, will largely depend on the sensitivity of the Personal Information and the reasonable expectations you might have in the circumstances.

You have the following choices with respect to your Personal Information:

Opt-Out of Marketing Communications. You may opt out of marketing-related electronic messages by using the applicable unsubscribe procedure in each communication (for example, by clicking on an unsubscribe link in an e-mail).

Cookies. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all the functionality of our website. Advertising Choices. You can limit use of your information for interest-based advertising by:

  • Privacy Browsers/Plug-Ins. By using privacy browsers or ad-blocking browser plug-ins that let you block tracking technologies.
  • Platform Settings. Google and Facebook offer opt-out features that let you opt out of the use of your information for interest-based advertising:

Right to Withdraw Consent. You may withdraw your consent to our collection, use, disclosure and retention of your Personal Information as set out in this Privacy Statement at any time, subject to legal or contractual restrictions and reasonable notice. To withdraw your consent, you may contact our Privacy Officer at the address noted below in Section 16.

 

  1. How do we ensure the privacy of your Personal Information when dealing with our affiliates and other third parties?

We and all affiliates and other third parties that are engaged to perform services on our behalf and are provided with Personal Information are contractually required to observe the intent of this Privacy Statement and our privacy practices and to protect your Personal Information.

 

  1. How long will we utilize, disclose or retain your Personal Information?

We may keep a record of your Personal Information, correspondence or comments, in a file specific to you. We will utilize, disclose or retain your Personal Information for as long as necessary to fulfill the purposes for which that Personal Information was collected and as permitted or required by law. Once no longer required, your Personal Information will be securely destroyed or anonymized (as permitted by law) so that the information can no longer identify you.

 

  1. How can you review your Personal Information that we have collected, utilized or disclosed?

If you make a written request to review any Personal Information about you that we have collected, utilized or disclosed, we will provide you with any such Personal Information to the extent required by law. We will attempt to make such Personal Information available to you in a form that is generally understandable. To make an access request, you may contact us at the address noted below in Section 16.

 

  1. How do you know that the Personal Information we have on you is accurate?

We will attempt to ensure that your Personal Information is kept as accurate, complete and up-to-date as possible. We will not routinely update your Personal Information, unless such a process is necessary. We expect you, from time to time, to supply us with written updates to your Personal Information, when required.

 

  1. What if the Personal Information we have on you is inaccurate?

At any time, you can challenge the accuracy or completeness of your Personal Information in our records. If you successfully demonstrate that your Personal Information in our records is inaccurate or incomplete, we will amend the Personal Information as required. Where appropriate, we will transmit the amended information to third parties having access to your Personal Information. To make a correction request, you may contact us at the address noted below in Section 16.

 

  1. How fast will we respond to your written requests?

We will attempt to respond to each of your written requests not later than thirty (14) days after receipt of such requests. We will advise you in writing if we cannot meet your requests within this time limit. You have the right to make a complaint to the Privacy Commissioner of Canada or applicable provincial privacy commissioner in respect of this time limit.

 

  1. Are there any costs to you for requesting information about your Personal Information or our privacy practices? 

We will not charge any costs for you to access your Personal Information in our records without first providing you with an estimate of the approximate costs, if any.

 

  1. How do we know that it is really you requesting your Personal Information?

We may request that you provide sufficient identification to permit access to the existence, use or disclosure of your Personal Information. Any such identifying information shall be used only for this purpose.

 

  1. What safeguards have we implemented to protect your Personal Information and what is our privacy governance framework?

We have implemented physical, organizational, contractual and technological security measures in an effort to protect your Personal Information from loss or theft, unauthorized access, disclosure, copying, use or modification. We have taken steps to ensure that only employees who are granted access to your Personal Information are those with a business ‘need-to-know’ or whose duties reasonably require such information.
